Terms and Conditions
Applicability
These Terms and Conditions govern all services provided by Forty6 Design Limited. Acceptance of these terms is not contingent upon a physical signature by the client. Agreement to these Terms and Conditions is deemed established upon the client’s acceptance of a quotation or engagement of our services.
Quotations, Invoicing, and Payment
- Quotations are valid for 30 days from the date issued and are subject to adjustment should project specifications change.
- A deposit of 30% of the total project cost is required to commence work. Should there be any delay in payment, all agreed project deadlines will be extended by an equivalent number of days to the delay in payment.
- Should there be a client-induced delay exceeding 10 working days without prior agreement, an invoice for the work completed to date will be issued, with payment due within 7 days.
- Upon project completion or ‘go-live’, the final invoice for the remaining 70% of the project cost will be issued, with payment due within 7 days of the invoice being issued.
- Any change to the project specification during the build phase will necessitate a revised quotation and may require an additional deposit reflecting the new cost structure.
- We reserve the right to suspend access to or remove all online materials in the event of non-compliance with our payment terms.
- For smaller ad hoc changes valued at up to £1,000, no deposit is required. However, all other terms and conditions remain applicable.
Termination
- The client may terminate the contract at any point during the project. All work performed up to the point of termination will be invoiced as ‘hours worked’. Although quotations are estimates, significant deviations from the project brief may incur additional charges.
Support and Ongoing Work
- Post-project support is billed at an hourly rate according to our current rate card, with a minimum billing increment of 0.5 hours. We reserve the right to amend our rates and will provide 30 days’ notice of any changes. Support work is invoiced monthly in arrears and detailed quotations for support work are not routinely provided unless requested.
Security Updates and Backups
- Our security services include uptime monitoring, core and plugin updates, real-time security monitoring (including IP blocking and brute force blocking), and daily database backups. While we strive for optimal security, we cannot guarantee that data will never be lost or compromised, particularly if client login credentials are mishandled.
- Revisions and Feedback
- Clients will have multiple opportunities to provide feedback and request revisions during the design and development phases. Charges may apply for significant deviations from the agreed project specifications.
Project Deadlines and Turnaround
- Project timelines and deadlines are agreed upon at the outset of the project. Client responsiveness and the timely provision of materials significantly impact our ability to meet these timelines.
- Browser and Operating System Compatibility
- Our websites are tested across the most commonly used browsers and operating systems to ensure compatibility. Specific compatibility requirements must be communicated prior to the start of the project.
Intellectual Property and Credits
Upon full payment, ownership of the completed website transfers to the client. Unless otherwise agreed, our design credit must remain visible on the website for 12 months post go-live. We reserve the right to feature the website in our portfolio unless otherwise negotiated.
Limitation of Liability
- Forty6 Design Limited, including its employees and agents, shall not be liable for any loss or damage arising from inaccuracies, omissions, delays, or the loss or damage of client content or media.
